Which companies are affected

The Accessibility Reinforcement Act (BFSG), which comes into force on 28 June 2025, particularly affects companies that offer products and services online. This includes the following categories of companies:

Hospitals, medical practices and telemedicine providers.

These companies must ensure that their digital content and services are accessible in order to comply with legal requirements and avoid heavy penalties or even the shutdown of their websites.

Who is affected by barriers on the Internet?

Many people experience limitations in everyday life, both online and offline. These limitations can be motor, visual, acoustic or cognitive in nature and range from mild to severe.

If access to information or services is made difficult by such limitations, this is referred to as a disability. In fact, many people have limited or no access to websites if they are not designed to be accessible.

To better understand who is affected by barriers on the internet, it helps to look at the different types of disabilities.

Many of these limitations exist from birth or develop over the course of a person's life and are permanent.

People with such permanent limitations are dependent on accessibility in order to be able to participate on an equal footing.

However, people with temporary or situational limitations are also affected.

A broken arm can heal, but operating a mouse is difficult during recovery.

In bright sunlight, it can be difficult to recognise content on a screen, even without visual impairment.

These examples show that accessibility ultimately benefits everyone, as anyone can find themselves in such a situation.

Implementing accessibility in web applications is a multi-layered process that encompasses technical, design and editorial aspects. Here are some key measures:

  1. Use of semantic HTML

    Use HTML elements correctly to characterise the structure and meaning of the content. headings (<h1>, <h2>), paragraphs (<p>), lists (<ul>, <ol>) and form elements (<form>, <label>, <input>) are crucial for machine readability and therefore for use by screen readers.

  2. Alt texts for images

    Add descriptive alternative texts (alt attributes) to all images so that screen reader users can understand the content.

  3. Contrast ratios

    Make sure that the contrast between text and background complies with the WCAG guidelines. A minimum contrast ratio of 4.5:1 for normal text and 3:1 for large text should be maintained

  4. Keyboard navigation

    Make sure that all interactive elements (links, buttons, forms) can be operated using the keyboard. Use ARIA roles and attributes to improve accessibility

  5. Responsive design

    Use a responsive design that adapts to different screen sizes and orientations. This helps users with different devices and supports adaptive technologies

  6. Subtitles and transcripts

    Provide subtitles for videos and transcripts for audio content so that users with hearing impairments can also understand the content.

  7. Simple language

    Write content in clear and understandable language. Avoid complex sentences and technical jargon to increase comprehensibility for all users

  8. Error messages and help

    Provide clear and understandable error messages and offer contextualised help to support users in using the application.

  9. Regular tests and reviews

    Conduct regular accessibility tests to ensure that the web application complies with current standards. Use tools such as WAVE, axe and Lighthouse to identify and eliminate potential barriers.

  10. Consideration of the WCAG guidelines

    Follow the Web Content Accessibility Guidelines (WCAG) 2.1 or 2.2. These guidelines provide comprehensive instructions for designing accessible web content.

Accessibility: legal basis

On 26 October 2016, the EU Directive (EU) 2016/2102 was published, which standardises the minimum accessibility requirements for websites and mobile applications of public sector bodies across Europe.

in 2018, these requirements were specified in an EU standard based on the Web Content Accessibility Guidelines (WCAG 2.1), an international standard for accessible web content.

In Germany, the Disability Equality Act (BGG) was subsequently amended and the corresponding provisions were specified in the Barrier-free Information Technology Ordinance (BITV 2.0), which is also based on WCAG 2.1.

Following the implementation of the directives for the public sector, regulations for the private sector followed in 2019 with EU Directive (EU) 2019/882.

In Germany, the Accessibility Reinforcement Act (BFSG) was subsequently passed in 2021 and will come into force on 28 June 2025.

Companies have until this date to adapt their digital offerings before the accessibility requirements become mandatory.
